ESG trend: Green Business Entities
There has been a long-standing debate in academic circles about the real purpose of companies. The classical approach, which has also been adopted by Slovenian legislator, emphasises that the purpose of companies is to carry out exclusively profit-making activities in order to realize a profit (Article 4(1) and (2) of the Slovenian Companies Act; ZGD-1). Hence, in Slovenia we have enacted a theoretical approach that emphasises the benefits of shareholders (shareholder theory). A new theory, however, emphasises that companies shall not solely pursue benefits of their shareholders but must also consider benefits of all stakeholders, including employees, suppliers, NGOs and the wider community (stakeholder theory).

Novelties in Slovenian legislation: Act determining the aid to the economy due to high electricity and natural gas prices
On September 10, 2022 the new Act determining the aid to the economy due to high electricity and natural gas prices (Official Gazette of Republic of Slovenia, No. 117/22) entered into force. The Act was prepared by the Ministry of Economic Development and Technology and aims to help companies in mitigating the effects of high prices on this year’s operations.

Ukraine conflict: EU adopts sixth package of sanctions against Russia
As the invasion of Ukraine continues for the fourth month, the European Commission adopts the sixth package of restrictive measures against Russia. Together with the previous five packages, the sanctions are designed to further increase economic pressure on Russia and undermine its ability to wage its war on Ukraine. The sixth package also imposes further sanctions against Belarus for its involvement in the aggression.

Political agreement reached on the Digital Services Act
On April 23, 2022, the European Parliament and EU Member States reached a political agreement on the Digital Services Act, which the European Commission proposed in 2020. European legislation in this area is obsolete – the area of digital services was last regulated more than 20 years ago, while the proliferation of counterfeit goods, hate speech and cyber threats showed the need to modernize it.

Novelties in Slovenian legislation: Amendments to the Agricultural Land Act
On April 13, 2022 the Amendments to the Agricultural Land Act (ZKZ) (Official Gazette of Republic of Slovenia, No. 44/22) entered into force. Members of Parliament adopted the amendments on their 30th regular parliamentary session, where some other acts in the fields of agriculture, forestry, hunting and fishing have also been approved.

Obtaining temporary protection for displaced persons from Ukraine
Due to the crisis situation in Ukraine and the mass influx of people fleeing the war, the Council of the European Union decided in early March to activate temporary protection for displaced persons in the European Union, providing temporary protection for Ukrainian displaced persons due to military invasion of Russian armed forces. In accordance with this decision, Slovenia also adopted its own Decision on the introduction of temporary protection for displaced persons from Ukraine in the Republic of Slovenia (Official Gazette of the Republic of Slovenia, No. 32/22), which entered into force on March 10, 2022. Since the war situation is not improving, the information on the process of obtaining temporary protection is still more than relevant. The process is described in more detail below.
